These Terms of Service (“Terms”) govern your use of the Specialist Disability Accommodation (“SDA”) services provided by Liverty Housing (“Liverty”, “we”, “us”, or “our”). By accessing or using our SDA services, you agree to be bound by these Terms.
1. Use of Services
1.1 Eligibility: Our SDA services are available to individuals who are eligible for Specialist Disability Accommodation as defined by the National Disability Insurance Scheme (NDIS) or other relevant authorities.
1.2 Compliance: You agree to comply with all applicable laws and regulations governing the provision and use of SDA services, including but not limited to the NDIS Act 2013 and associated rules and guidelines.
1.3 Registration: In order to access certain features of our SDA services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to ensure its accuracy.
1.4 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
2. Provision of Services
2.1 Availability: We will use reasonable efforts to make our SDA services available at all times. However, we do not guarantee uninterrupted or error-free access to our services, and we reserve the right to suspend or terminate access to our services at any time and for any reason.
2.2 Modifications: We reserve the right to modify or discontinue our SDA services (or any part thereof) at any time without prior notice.
3. User Responsibility
3.1 Use Restrictions: You agree not to use our SDA services for any unlawful or unauthorized purpose, or in any manner that could damage, disable, overburden, or impair our servers or networks.
3.2 Content: You are solely responsible for any content that you submit, post, or display on or through our SDA services. You agree not to submit, post, or display any content that is unlawful, defamatory, obscene, offensive, or otherwise objectionable.
3.3 Compliance with Policies: You agree to comply with all policies and guidelines posted on our website or otherwise communicated to you in relation to our SDA services.
4. Intellectual Property
4.1 Ownership: All intellectual property rights in our SDA services, including but not limited to trademarks, service marks, logos, and copyrights, are owned or licensed by Liverty Housing.
4.2 License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use our SDA services for your personal or internal business purposes.
5. Limitation of Liability
5.1 Disclaimer: To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with our SDA services, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
5.2 Limitation of Liability: In no event shall Liverty Housing be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of our SDA services.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
